Les présentes conditions de vente s'appliquent sans restriction à l'ensemble des prestations proposées par Magalie Fontaine, ainsi qu'à l'ensemble de ses clients.
La lecture attentive et l'acceptation de ces CGV (Conditions Générales de Ventes) sont une obligation avant toute prise de rendez-vous.
PREAMBULE
Les présentes conditions générales de vente s'appliquent à toutes les prestations de services qui sont réservées par tous moyens, et ce à l'ensemble des clients, quel que soit leur statut ou leur qualité. Le choix et la réservation d'une prestation est de la seule responsabilité du client. La prise de rendez-vous implique l'adhésion du Client aux présentes CGV et leur acceptation sans réserve. Le Client déclare avoir pris connaissance des présentes CGV et les accepter sans restriction ni réserve. Le Client déclare qu'il a bénéficié des conseils et informations nécessaires afin de s'assurer de l'adéquation de l'offre à ses besoins.
La liste et le descriptif des services proposées par l'entreprise individuelle peuvent être consultés sur le site www.la-memoire-des-mains.fr.
Magalie Fontaine se réserve le droit de modifier à tout moment les présentes CGV, étant précisé que les modifications seront applicables aux seules commandes passées après l'entrée en vigueur desdites modifications.
Tout autre document que les présentes CGV et notamment les publicités, prospectus, dépliants, n'a qu'une valeur informative de l'activité proposée par "Magalie Fontaine" et est non contractuel.
AVERTISSEMENT: CONTRE-INDICATIONS
Magalie Fontaine recommande au Client de demander l'avis préalable de son médecin traitant avant de réserver une prestation en cas de grossesse, de pathologie grave, de problèmes cardiaques, d'allergies, ou de fragilité physique ou émotionnelle extrême (liste non exhaustive).
Pour les femmes enceintes, la réflexologie est contre-indiquée dans les 3 premiers mois de grossesse, en respect du principe de précaution. Après 3 mois, il est recommandé à la Cliente de demander l'avis préalable de son médecin si elle en ressent le besoin et d'en informer Magalie Fontaine lors de la prise de rendez-vous.
Les massages bien-être proposés par Magalie Fontaine sont contre-indiqués pendant toute la grossesse.
Durant le premier rendez-vous, Magalie Fontaine établit un bilan complet avec le Client couvrant son état personnel, sa santé générale et ses antécédents, afin d'identifier les éventuelles contre-indications aux séances et de proposer la pratique d'accompagnement la plus adapté, en absence de contre-indications. Le Client est donc tenu de l'informer de son état de santé général de manière véridique et complète. A la lecture des présentes CGV, le Client est informé et accepte qu'il existe des contre-indications aux pratiques de bien-être proposées, ainsi que des interactions médicamenteuses, Le Client s'engage à informer Magalie Fontaine de tous changements sur son état de santé lors de ses prochains rendez-vous.
ARTICLE 1: MENTIONS LEGALES
Les prestations proposées par Magalie Fontaine sont exclusivement dédiées au bien-être de la personne, au travers de la réflexologie et des massages bien-être. Compte tenu de la loi du 30.04.1946, décret 60669 de l’article l.489 et de l’arrêté du 8.10.1996, modifié par décret n° 2000-577 du 27 Juin 2000 et l'article loi n° 2016-41 parue au JO le 27 janvier 2016 par la modification de l’article L. 4321-1, toutes les prestations et techniques proposées ne se substituent à aucun traitement médical ou de kinésithérapie et ne dispensent pas d'un diagnostic établi par votre médecin.
Les prestations proposées par Magalie Fontaine sont issues de Méthodes Traditionnelles ancestrales visant à rétablir l'équilibre du corps par le biais de techniques de bien-être, par la relaxation physique et la détente libératrice du stress. Sont exclues les prestations à caractère érotique ou sexuel.
Le Client s'engage à rester courtois et poli pendant les prestations, et à ne pas faire de propositions déplacées concernant des prestations illégales, de ne pas être entreprenant avec la prestataire, sous peine de poursuite judiciaire.
ARTICLE 2: CONDITIONS DE REALISATION DES PRESTATIONS
Il appartient au Client de faire toutes vérifications qui semblent nécessaires ou opportunes avant de procéder à une quelconque réservation de prestation auprès de Magalie Fontaine. Le Client devra se conformer aux conseils et aux recommandations de Magalie Fontaine, notamment au niveau des indications et contre-indications aux pratiques proposées. En vertu du principe de précaution, Magalie Fontaine peut refuser de réaliser les prestations en cas de contre-indication médicale à la séance, sans un avis médical préalable.
Magalie Fontaine n'intervient que sur rendez-vous, dans le respect de la vie privée de son Client, de sa dignité et de sa liberté. Elle tient compte des limites de ses compétences, ses connaissances, ainsi que des moyens dont elle dispose.
Les prestations sont proposées du lundi au vendredi.
Les prestations sont proposées aux Clients majeurs et aux Clients mineurs accompagnés d'un de leurs représentants légaux ou ayant une autorisation écrite de leurs représentants légaux à la pratique des différentes prestations proposées par Magalie Fontaine.
Les prestations de massage bien-être lymphodrainant et ayurvédique sont réservées exclusivement aux femmes.
Magalie Fontaine s'engage à respecter les règles d'hygiène personnelle et vestimentaire nécessaire à la sécurité et au bon déroulement de la séance.
Concernant l'usage des huiles essentielles, Magalie Fontaine tiendra compte des allergies ou irritations possibles, et des interactions avec des troubles ou traitements en cours, avant de proposer l'usage d'une huile essentielle lors d'une séance.
ARTICLE 3: RENDEZ-VOUS
Le Client peut réserver, après échange avec Magalie Fontaine, un rendez-vous pour une prestation. Il communique alors ses coordonnées de contact (nom, prénom, téléphone). Magalie Fontaine envoie un message de rappel par SMS 24 heures avant le rendez-vous.
Les horaires de rendez-vous sont respectés et Magalie Fontaine se réserve le droit en cas de retard de plus de 20 minutes de refuser d'exécuter la prestation afin de ne pas perturber son planning. En deça de cette durée, la durée de la prestation pourra être réduite de la durée du retard.
En cas d'annulation de rendez-vous intempestive, Magalie Fontaine se réserve le droit de refuser de fixer un nouveau rendez-vous au Client pour raisons personnelles.
ARTICLE 4: PRIX, MOYENS ET CONDITIONS DE PAIEMENT
Les prestations de Magalie Fontaine sont payables le jour de la prestation, à l'issue de sa réalisation, en espèces, par chèque bancaire à l'ordre de Magalie Fontaine, ou par virement bancaire immédiat.
Dans le cas d'une formule, la réduction forfaitaire est appliquée à la dernière séance.
Le paiement des bons cadeaux est exigible à la commande, et pourra être réalisé en espèces, par chèque bancaire ou par virement bancaire.
ARTICLE 5: BONS CADEAUX
Le ou les bon(s) cadeau ne sont valables qu'après paiement et sont nominatifs, non échangeables et non cessibles, sauf accord de Magalie Fontaine.
Tout bon cadeau arrivé à sa date d'expiration ne pourra plus être utilisé ni être remboursé.
Si le bénéficiaire du bon cadeau ne se présente pas à son rendez-vous, sans avoir au préalable signalé son empêchement à Magalie Fontaine, verra sa séance débitée de son bon cadeau.
Le bon cadeau pourra être envoyé par courrier par Magalie Fontaine à l'adresse de livraison qui a été indiquée lors de la commande et au délai indiqué, sans frais supplémentaire. Il pourra également être envoyé par courrier électronique à l'adresse courriel indiqué lors de la commande et au délai indiqué.
ARTICLE 6: CARTE FIDELITE
Magalie Fontaine propose au Client une carte fidélité matérialisée, rattachée à sa personne propre et non cessible à une tierce personne. Un tampon est apposé sur la carte fidélité à chaque prestation effectuée pour le Client. Magalie Fontaine propose des promotions commerciales pour les détenteurs de la carte fidélité.
ARTICLE 7: LIEU D'EXERCICE ET D'INTERVENTION
Magalie Fontaine exerce son activité à son cabinet situé au 20, boulevard Aristide BRIAND 63400 CHAMALIERES.
Toutefois, suite à accord entre les parties, Magalie Fontaine pourra effectuer sa prestation au domicile du Client. Des frais de déplacement seront alors facturés en sus des prix indiqués sur le site Internet https://www.la-memoire-des-mains.fr, sur la base de 50 centimes d'euro par kilomètre à partir du cabinet. Dans les cas particuliers de situation de handicap moteur temporaire ou permanent du Client, Magalie Fontaine pourra se déplacer gracieusement au domicile du Client pour effectuer la prestation. Les prestations à domicile couvrent l’intégralité des services de Magalie Fontaine, étant entendu que la fourniture des services dépend de l’absence de contre-indications médicales, telles que décrites dans chaque page descriptive des services sur le site Internet https://www.la-memoire-des-mains.fr.
ARTICLE 8: FORCE MAJEURE
L'exécution des obligations de Magalie Fontaine au terme des présentes CGV est suspendue en cas de survenance d'événements de de force majeure, extérieurs et indépendants de la volonté de Magalie Fontaine, qui en empêcherait l'exécution. Magalie Fontaine avisera le Client de la survenance d'un tel événement dès que possible.
ARTICLE 9: INCAPACITE DE TRAVAIL
En cas d'incapacité temporaire d'exercice, par suite de maladie ou d'accident, Magalie Fontaine se réserve le droit de modifier la programmation des rendez-vous en concertation avec le Client sans qu'il puisse exiger un dédommagement. En cas d'incapacité permanente, tout contrat sera résilié sans qu'il puisse être réclamé à Magalie Fontaine une indemnité compensatrice.
ARTICLE 10: PROTECTION DES DONNEES PERSONNELLES
Conformément au Rectificatif du 23 mai 2018 au règlement (UE) 2016/679 du Parlement européen et du Conseil du 27 avril 2016 relatif à la protection des personnes physiques à l’égard du traitement des données à caractère personnel et à la libre circulation de ces données, et abrogeant la directive 95/46/CE (Règlement Général sur la Protection des Données), vous disposez d'un droit général d'accès, de modification, d'opposition pour un motif légitime et de rectification des données à caractère personnel qui vous concernent. ARTICLE 11: RESPONSABILITE CIVILE ET PROFESSIONNELLE
Magalie Fontaine a souscrit à une assurance en responsabilité civile et multi-risques exploitation pour l'exercice de ses prestations. Il est précisé que la responsabilité de Magalie Fontaine ne saurait être engagée en cas de dommages liés à la négligence d'un Client, en particulier s'il n'a pas révélé à Magalie Fontaine l'existence de contre-indication l'affectant, que ce soit lors de la saisie du bilan en début de séance (document d'information visant à alerter des contre-indications possibles et applicables) ou des rendez-vous ultérieurs, en cas de modification de son état de santé personnel.
ARTICLE 12: PROPRIETE INTELLECTUELLE
L’ensemble des éléments figurant sur le site de Magalie Fontaine sont protégés par les dispositions du Code de la Propriété Intellectuelle. En conséquence, toute reproduction de ceux-ci, totale ou partielle, ou imitation, sans l'accord exprès, préalable et écrit de Magalie Fontaine, est interdite.
Il est formellement interdit de collecter et d’utiliser les informations disponibles sur le site à des fins commerciales.

ARTICLE 13: MEDIATION DE LA CONSOMMATION
En cas de mécontentement, le Client est tenu d'en faire part à Magalie Fontaine immédiatement après la réalisation de la prestation. S'il est fondé et justifié, Magalie Fontaine pourra dispenser le Client du paiement de la prestation. Aucune demande de remboursement après paiement ne pourra être acceptée.
Les présentes CGV sont soumises au droit français. En cas de litige, compétence est attribuée aux tribunaux compétents. Avant toute action en justice, il sera fait recours à un service de médiation à la consommation.
Conformément aux articles L.616-1 et R.616-1 du code de la consommation, Magalie Fontaine propose un dispositif de médiation de la consommation. L'entité de médiation retenue est : CNPM MÉDIATION CONSOMMATION. WARNING: COUNTER-INDICATIONS

ARTICLE 1: LEGAL NOTICES

The services are offered to adult Customers and to Minor Customers accompanied by one of their legal representatives or having written authorization from their legal representatives in accordance with the various services offered by Magalie Fontaine.
Lymphatic draining and ayurvedic wellness massage services are reserved exclusively for women.
Magalie Fontaine undertakes to respect the rules of personal hygiene and clothing necessary for the safety and smooth running of the session.
Concerning the use of essential oils, Magalie Fontaine will take into account possible allergies or irritations, and interactions with current disorders or treatments, before proposing the use of an essential oil during a session.
ARTICLE 3: APPOINTMENTS
The Customer can reserve, after discussion with Magalie Fontaine, an appointment for a service. He then communicates his contact details (surname, first name, telephone). Magalie Fontaine sends a reminder message by text message 24 hours before the appointment.

ARTICLE 4: PRICES, PAYMENT METHODS AND CONDITIONS

ARTICLE 5: GIFT VOUCHERS
The gift voucher(s) are only valid after payment and are nominative, non-exchangeable and non-transferable, except with Magalie Fontaine's agreement.

ARTICLE 6: FIDELITY CARD

ARTICLE 7: PLACE OF EXERCISE AND INTERVENTION

ARTICLE 8: FORCE MAJEURE
